Judicial Sentence

Modification Granted

Under 22 O.S. § 982a

Easton Cohen recently obtained judicial sentence modification relief on behalf of a client serving a fifteen-year Oklahoma Department of Corrections sentence arising from a felony marijuana trafficking case involving the transportation of more than one hundred pounds of marijuana.

Approximately one year into the sentence, the Court granted judicial review relief under 22 O.S. § 982a and suspended the remainder of the sentence effective immediately following the hearing.

Unlike many post-conviction proceedings, the matter did not center on procedural challenges or technical defects related to the conviction itself. Instead, the presentation focused heavily on rehabilitation, accountability, institutional progress, leadership, and structured reintegration planning.

A Strategic & Rehabilitation-Focused Approach

The matter was approached intentionally from the outset of representation.

Shortly after sentencing, the possibility of future judicial review relief was identified and incorporated into a broader long-term strategy focused on rehabilitation, institutional conduct, accountability, and reintegration preparation.

Rather than relying exclusively on traditional motion practice, the judicial review presentation was structured more like a mitigation and reintegration review centered on public safety, institutional trust, and long-term stability.

Materials presented to the Court included:

  • Department of Corrections institutional records

  • Rehabilitation and program documentation

  • Leadership and work assignment history

  • Community support materials

  • Verified housing and reintegration planning

  • Structured accountability and release preparation

The presentation emphasized not only rehabilitation, but whether continued incarceration remained necessary to accomplish the goals of sentencing and protect the public.

Institutional Leadership & Reintegration Planning

A significant aspect of the case involved the client’s institutional progress while incarcerated.

The client completed substantial rehabilitative programming, obtained trusted institutional assignments, and was selected for increasing leadership responsibilities within the institution, including participation in the Therapeutic Community “Guardian” program involving accountability, mentorship, and institutional leadership responsibilities.

The Court was also presented with verified housing arrangements, employment opportunities, and long-term community support systems designed to support stability following release.
